Terms of Service

1. Object

These Terms of Service govern the use of the SaaS service Content Maker, published by Julen Giacomoni (hereinafter "The Publisher"), located at 8 rue Larralde Diusteguy, Urrugne 64122, France.

The service provides tools for organization, creation, community management, and content publication for social networks.

2. Access to the Service

Access to the service is restricted to individuals or legal entities capable of entering into contracts under French law.

Minimum Age: Use of the service is strictly prohibited for users under the age of 16. By using Content Maker, you certify that you are at least 16 years old.

3. Subscriptions and Payments

  • Model: The service is provided as a monthly subscription with no long-term commitment.
  • Payment: Payments are managed exclusively via our secure partner Stripe. No banking data passes directly through our servers.
  • Renewal: The subscription is automatically renewed each month.
  • Cancellation: Users may cancel their subscription at any time via their account dashboard. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.

4. Use of Meta APIs (Instagram & Threads)

Content Maker uses the official services of Meta (Instagram API and Threads API). By using our service, you agree to be bound by:

  • The Instagram Terms of Use.
  • The Threads Terms of Use.

Disclaimer: Content Maker is a third-party tool and is not affiliated with, sponsored by, or endorsed by Meta Platforms, Inc. We cannot guarantee permanent access to Meta's APIs. In the event of a service interruption due to a change in Meta's policies, Content Maker shall not be held liable.

5. Intellectual Property

  • User Content: You remain the sole owner of the content (text, images, videos) you create or publish via Content Maker.
  • Software: The interface, source code (backend/frontend), and AI assistance algorithms are the exclusive property of Julen Giacomoni. Any reproduction is prohibited.

6. Liability

Content Maker strives to provide 24/7 service availability. However:

  • We do not guarantee the absence of bugs or temporary interruptions (particularly related to maintenance of Contabo/Vercel servers or Supabase outages).
  • The Publisher shall not be held liable for direct or indirect consequences related to the use of content suggested by AI or published via the tool. The user remains solely responsible for their published content.

7. Personal Data

Data collection and processing are governed by our Privacy Policy.

8. Governing Law and Jurisdiction

These terms are governed by French law. In the event of a dispute, and failing an amicable agreement, exclusive jurisdiction is granted to the courts within the jurisdiction of the Publisher's registered office.
